LEWIS COUNTY, Ky. — According to reports from Lewis County District Court, John Garcia, 25, of Lewis County, Ky., who was charged in the stabbing death of David Reed in February of 2014, recently made an appearance in court.

Reports reveal that Public Defender Brian Hulett, attorney for Garcia, was court to discuss a report that was conducted on his client Garcia regarding his criminal responsibility in the death of Reed in 2014. According to reports, the discussion centered around discussion of the request of the attorney for the state of Kentucky’s request for copies to accompany Garcia to the Kentucky Correctional Psychiatric Center for an evaluation.

Court records reveal that the statute requires Hulett to turn the copies of the report over to the commonwealth 20 days before Garcia’s trial, which is scheduled for Sept. 21, 2015.

Hulett’s problem with the commonwealth’s request is that Garcia had been already been evaluated.

Judge Robert Conley, who is presiding over Garcia’s case, advised Hulett to review the statute before making a decision. Additionally, Conley reminded Hulett that if the report is handed over to the commonwealth 20 days prior to the trial, and any new information arises that there is a possibility that the trial would be postponed.

Lewis County Sheriff Johnny Bivens, said around 12:23 a.m. Sunday, Feb. 2, 2014, deputies responded to 265 Meadowbrook Drive to investigate reports that an individual had been murdered. Reed’s body was discovered by officers at the residence with multiple stabbing wounds, and pronounced dead by Lewis County Coroner Tony Gaydos. Garcia was located near the scene, and he was taken into custody by officers without incident.
