New Boston FOP accuses Donini of false statements

The New Boston Fraternal Order of Police Lodge No. 208 has filed an ethics violation complaint against incumbent Scioto County Sheriff Marty V. Donini, with the Ohio Elections Commission. That alleged violation charges Donini with making false statements of endorsement in campaign materials, which the Lodge says is a violation under Ohio Revised Code 3517.21 (B) (8) and 3517.21 (B) (10).

In drafting the letter, the president of Lodge No. 208, Lt. Diane Davis says she personally witnessed Donini and “several of his off-duty supervising deputies” going door to door in the Village of New Boston handing out and distributing campaign materials in plastic bags that read in bold black print - “Endorsed by Fraternal Order of Police Portsmouth-New Boston Police Lodge #33, Scioto County Sheriff’s Office Lodge #187.”

In the complaint, Davis points out that while New Boston police officers had at one time been members of FOP Lodge No. 33, which, at one time, was made up of both Portsmouth and New Boston police officers, that all changed in April of 2012 when the New Boston Police Department petitioned the Ohio State Fraternal Order of Police to separate from that Lodge in order to form their own Lodge.

“The formation of the New Boston FOP Lodge #208 and the separation away from the FOP Lodge #33 was advertised in the Portsmouth Daily Times which is the only daily newspaper in Scioto County by a news article that was done and published. The news article is enclosed as an exhibit for this complaint,” Davis said in the cover letter.

Davis went on to say, “Sheriff candidate Marty Donini is well aware the New Boston police officers are no longer part of the FOP Lodge #33.”

“Although I am the president of FOP Lodge #208, I am also a resident of New Boston and personally witnessed this and these materials were left on my front porch, as well as many other residents of New Boston,” Davis said in the complaint.

The complaint charges that Donini, “as an experienced elected official that has been in elected office for sixteen years,” should have made arrangements to either black out the words “New Boston Police Lodge” on the bags or the bags should have been done without that phrase.

Donini said on Tuesday afternoon that he had not received notification of a complaint being filed, and had only been informed by a call from the Portsmouth Daily Times.

“It’s not surprising. This is my fifth time to run for re-election, and it seems like each and every time I have always ended up in court because some inexperienced politician wants to argue some irrelevant issue,” Donini said. “With that having been said, in 1996, again in 2000, again in 2004, and again in 2012, I received the endorsement from FOP Lodge No. 33 which included members of the Portsmouth Police Department and the New Boston Police Department. I received the endorsement each and every time.”

Donini went on to say prior to the New Boston Police Department forming its own lodge he had ordered “thousands and thousands” of pieces of literature to be handed out.

“As a matter of fact, it was first brought to my attention when you (this reporter) wrote an article on June 30, I believe, that they had formed their own lodge,” Donini said. “The only issue is that my literature was not only ordered, but was also received in my hands prior to June 30. It was already a done deal. Since June 30, I have accepted the responsibility and changed all of my literature, all of my graphics to exclude the New Boston Police Department in any of the endorsements.”

Donini said everything that he has ordered after that announcement makes no mention of the New Boston Police Department.

“My point is that I was endorsed by FOP Lodge No. 33, and if you will read your (this reporter) article on March 7, you actually make a statement that members of the New Boston Police Department are also members of FOP Lodge No. 33,” Donini said. “Therefore I don’t think I did anything wrong. I don’t feel that our committee should have to forfeit the financial sources that we used to pay for these thousands and thousands of items. And I’m going to continue to disperse them as is because I stand by what it says. It says, Portsmouth-New Boston Lodge No. 33. When I received the endorsement that’s who made up that Lodge.”

The Ohio Elections Commission had not yet received the letter by late Tuesday afternoon, but said when complaints are filed, those complaints are given to the Commission’s staff attorney to make sure it is proper for the Commission. If it is, the Commission will send notice as to a date for a hearing on the issue. The spokesman said what action is taken depends on the allegation at hand.

“If it’s alleging a false statement, it will go before a Probable Cause Panel,” a Commission spokesman said.

He said the panel would be made up of either one Democrat, one Republican and one Independent, or two Democrats and two Republicans. “They’ll determine whether or not the complaint holds merit or whether there has been probable cause for a violation.”

FOP Lodge No. 208 made a point of making no endorsement of any candidate after the formation of their Lodge.

I just wonder how the Times decides what comments to print and what comments to leave out. I assume it's an editorial decision based on some kind of criteria set to community standards. Or, perhaps its the decision of the author of the article. Either way, I would like to be able to read all the comments deemed fit to print. A controversial story such as this may require many different opinions to formulate addition insight. I assume a followup will come after the decision about the alleged offense. Anyway, does the paper still endorse candidates for local, state, and public office. Just want to know.

Hey Frank, maybe you need to ask Donini to show you his endorsement letter from Lodge#33, Portsmouth-New Boston Police Lodge#33 is not the real name of that lodge, under the incorperated title, I saw it was Scioto Lodge#33. If Donini was not trying to mislead people in New Boston and in this county, why he he take it upon himself to change the real name of Lodge#33 for his campaign materials and bags to show that New Boston is supposedly behind him. I checked online with endorsements other other FOP's in other counties and they all use their incorperated names on file with the State. Donini wants everyone to believe he had to throw all these bags away since he already paid for them, it does not costs anything to take a dark pen marker and just black out the name as the complaint says.

Hats off to Frank Lewis, he got all the facts in the article to make it easy to understand. A regular scheduled meeting was held by FOP Lodge 33 that includes members from the New Boston Police Department and The Portsmouth Police Department. Those members that took the time to attend the meeting to have a voice in lodge business were there. A legal vote was taken by members present and they voted to endorse Donini. Just because New Boston decided to pull out of the lodge after the fact would not change the endorsement. Donini stated that he stopped using New Boston in future orders he made for material, Although I feel he could have continued using New Boston because they were part of the endorsement, He took the proper avenue as he always has in doing what is right. And I agree with Rhapsody35 For New Boston Police to pull out of Lodge 33 to form their own FOP Lodge and then NOT endorse there supervisor, This speaks loudly to me.

Tommy B55 sounds like it to me you clearly don't have your facts straight. The NewBoston police Department formed their own lodge after Goins was not endorsed to try and get an endorsement for him and yes they voted and his own department the officers who know him best voted not to endorse him 4 votes against 2 for him that means Diane Powell and only one other voted for him. If you don't have teh support of your own people who work with you everyday how can you get the support of others????

Lt. Davis you got to be kidding! The statement is what it is! Donini received the endorsement from the Fraternal Order of Police, Portsmouth – New Boston Police Lodge #33! What part of that is untrue? Donini received that same endorsement each and every time he has repeatedly gone through this political process, never an issue! Why is it all the sudden, after 109 years you and your fellow employees feel a need to remove yourselves from the long established and credible Fraternal Organization FOP Lodge #33 which has over the years included many very fine men and women who have committed their lives to serving our community? I’ll tell you why! It’s called “whining” and it’s also known as attempting to “manipulate” the political process since things haven’t gone a certain way! False statements or in other words….. Lying? Yea right! Shame on you! We the voters aren’t as naïve as you may think!

Donini, it amazes me why you would continue to subject yourself and your family to our local negative political process when someone is always there to try to tarnish your representation and try to make you out as the bad guy! I remember how the Sentinal use to “trash” you all the time about anything and everything any yet our community has continued to make the right choice to re-elect you each and every time. You’re a class act and you got my vote as you have each and every time in the past. What really bothers me about this article is what wasn’t printed! There was no mention how after the endorsement was announced, your opponent (Goins) approached FOP Lodge #33 and began ranting, raving and yelling about “his” dissatisfaction concerning the endorsement for Donini and threatened to convince the New Boston officers to leave FOP Lodge #33. This conduct is unacceptable and we don’t need leaders in our community who can’t control their temper. And then all the sudden after 109 years (as noted in a news article) after being members of the FOP Lodge #33 the New Boston Police Department formed their own FOP Lodge. What’s more amazing is how the newly formed New Boston Police Department FOP Lodge “refused” to endorse the candidate who has and currently is employed as a high ranking supervisor by the New Boston Police Department. Hey, who knows Goins better than anyone! The employees who refused to endorse him. This message is clear and speaks in volume!

If you read the daily times article back then on Donini's endorsement it says only 12 members showed up and voted to endorsed him out of over 40 members. Don't sound to much of a vote of confidence or endorsement for him. I am friends with several members of the FOP#33 lodge and what you said about Goins ranting, yelling at a meeting is nothing but a lie.

Several of the members themselves were upset that a majority of the lodge members were not notified about the meeting and that there was going to be a vote of any kind. Those members said Goins and all of the New Boston Officers came to the next meeting and they expressed why a majority of the members were not notified about the meeting for voting and no one was yelling and ranting, you seem to distort the truth as Donini. Several wanted to stay out of the election race and not endorse anyone. But as they said, a majority of the members were not told about any vote. This sounds like tweleve people who are frineds of Donini and got together and voted without a majority of the members knowing that.

The New Boston Officers were not given any notice or a chance to vote or express the opinion.

By New Boston puling out of that lodge should tell people that the proceeding that endorsed Donini was not done on the up and up. If Goins could not get his department to endorse him, I DO NOT think he could get them to pull out of Lodge#33. That SAYS volumes on how several of Donini's poticial friends who are lodge members uses their position as cops to abuse the political process. I know most of the New Boston Officers and all are supporting him, but they chosed to stay out of a politcal race and not to create hard feelings between other officers from other departments. I think FOP Lodges need to stay out of candidates races and only endorse issues that are good for the people they serve.

I agree with the New Boston Lodge, it does not cost anything for Donini to just black out the name with a marker, you do not have to throw them away as Donini wants everyone to believe he has to. New Boston is right, Donini is an experienced elected official who knew what he was doing by still using the New Boston Police name and that is deceiving the people of this county.
