Inmate reconsiders execution, asks to join injection lawsuit

COLUMBUS - A condemned inmate who gave up his appeals ahead of next week's execution has reconsidered and asked Friday for an emergency delay so he can join a lawsuit declaring death by injection unconstitutional.

Convicted killer James Filiaggi asked the Ohio Supreme Court to stop his execution scheduled for Tuesday.

Filiaggi, 41, says he needs the delay while a federal judge considers his request, filed Thursday, to join a lawsuit contending lethal injection constitutes cruel and unusual punishment.

Injection is unconstitutional because it will in effect cause Filiaggi to be tortured to death, he argues in court documents filed with U.S. District Court Judge Gregory Frost.
