A registered sex offender being sought by Scioto County authorities since 2005, has been arrested in Dodge City, Kan.

James A. Gordon, 35, of Portsmouth is being held in the jail there while he awaits extradition back to Ohio.

“They are holding him on our warrant right now, but they are looking into filing on failure to register also,” Scioto County Sheriff's Captain David Hall told the Portsmouth Daily Times. “If not, we'll be going out to pick him up.”

Scioto County Sheriff Marty Donini said his office filed for a warrant to arrest Gordon, a registered Tier III sex offender since 2005, for failing to verify his residence. Gordon, as required by law, was sent a sevev-day notice to verify his residence. That complaint was filed with the Sheriff’s Office after the community of Timmonds Avenue in Portsmouth filed the complaint that James Gordon did not reside at the address he registered with. After further investigation by the Sheriff’s Office it was confirmed that Gordon was not living at that address.

After Gordon did not respond to the verification letter as required by law, a warrant for failure to verify, a felony of the first degree was issued for his arrest. On Tuesday, Gordon was located in Dodge City, and with the assistance of the Dodge City Police Department, Gordon was arrested without incident.

Hall said Scioto County authorities had a lead that Gordon was in that area, prior to his arrest

“I actually talked to them (Dodge City authorities) a couple of times this week, and they called me back on Wednesday, and told me they located him,” Hall said. “He will be extradited back here to Ohio, and I'm sure that the (Scioto) County Prosecutor's Office will look into filing additional charges on him for failure to register, a felony of the first degree. In Ohio it's the same level of offense that they were convicted on, and his conviction was for rape, a felony of the first degree.”

Donini said his office takes the sexual offender registration very serious and has a zero tolerance for offenders who fail to stay in compliance.

Donini said his office does monitor the addresses of offenders and if someone believes that or knows that an offender is falsely using a different address, they may contact the Scioto County Sheriff’s office and speak with Captain David Hall.
