Garcia pleads not guilty of murder

VANCEBURG, Ky. — According to reports from the Lewis County District Court Clerk’s office, John Garcia, 23, entered a plea of not guilty to the fatal stabbing of David Reed, 46, on Feb. 2, 2014. The case has been handed over to grand jury.

District Court Clerk staff said Reed stood before District Court Judge Brian C. McCloud on Tuesday. McCloud made a determination of sufficient probable cause after hearing the testimony Lewis County Sheriff’s deputy.

Lewis County Sheriff Johnny Bivens, said around 12:23 a.m. Sunday, deputies responded to 265 Meadowbrook Drive to investigate reports that an individual had been murdered. Reed’s body was discovered by officers at the residence with multiple stabbing wounds, and pronounced dead by Lewis County Coroner Tony Gaydos. Garcia was located near the scene, and he was taken into custody by officers without incident.

“We were there in just a couple of minutes. He remained in the area and basically he didn’t try to flee,” Bivens said. “Obviously he was saying he had no choice but to do what he did.”

According to Bivens, the preliminary investigation revealed that Garcia and Reed were acquaintances and Garcia was visiting at the residence. It was during that time, Bivens said, an altercation occurred between the two men, and that led to the fatal stabbing of Reed. He said officers located and recovered the weapon at the scene.

Garcia is being held in the Lewis County Detention Center without bond as ordered by McCloud.

Lewis County District Court Clerk’s office said a Lewis County grand jury is expected to convene about the case Feb. 28.
